The following terms and conditions ("the Conditions") apply to all transactions processed by Crown Group (UK) Ltd (t/a "Sleep Bed Centres"). All orders made are subject to the acceptance of these Conditions, and deemed to be accepted by you when placing your order. These Conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions.

30 Night's Home Trial

1. PAYMENT

1.1 We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins when we confirm acceptance of your offer to purchase goods from us. An order will not take place (and we will not be deemed to have accepted your order) until we have validated and confirmed your payment. Any communication, which you receive from us prior to validation, is not to be deemed as an acceptance of your order. In the event of any pricing error occurring within our website, within a written or verbal quotation, or contained within any fax or e-mail correspondence however received, all orders shall be deemed void.

1.2 We accept all major credit cards, cheques, wire transfer & BACS payments. In addition we accept official purchase orders from Local Authorities, Government, Education, Financial, Healthcare, & other official corporate bodies at our sole discretion.

1.3 All cheques, BACS, and wire payments must be cleared before any goods can be dispatched (please allow up to 7 working days for clearance). However, no goods will be dispatched until we are in receipt of the original order. For BACS payment details please contact our customer services deaprtment.

1.4 Ownership of the goods shall not pass to you until we have received payment in full (cleared funds).

1.5 Your order for goods is subject to stock availability. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.

1.6 All prices quoted or displayed are in UK pounds sterling and shall be the price, inclusive of VAT & delivery, set out on the website at the time your order is placed. A delivery charge may be added and clearly shown in the orders section of the shopping cart before any online order can be placed, or as quoted by phone. We are entitled to make adjustments to the price to take account of any increase in, or the imposition of any new taxes or duties. If due to an error or omission the price published for the goods on our website is wrong we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but should an error occur we would inform you of the correct price and give you an opportunity to cancel the order.

1.7 Payment for goods must be made in accordance with our purchase procedure as set out on our website. All orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any details you provide us with that are incorrect or if any order is held up as a result of incorrect or unsubstantiated details.

2. GUARANTEE

2.1 All new goods are sold with the benefit of a minimum 12-month manufacturer's guarantee. Full guarantee details are available with your product, or from our customer services team. It is your responsibility to complete and return the purchase registration form enclosed with the goods to the manufacturer.

2.2 If these goods are deemed tampered with in any way your guarantee will become void and you will become responsible for the costs of replacement and return shipping. If no manufacturing fault is found you will be responsible for the costs of replacement and return shipping. Wherever possible we will respond to your individual circumstances. The Sleep Bed Centres will not be liable for any transit damage that may occur on any product you have returned to us for replacement. We strongly suggest that you make sure you have used sufficient packaging to protect your product and insure against damage before returning any product for replacement. For advice on how to pack your goods safely before return please contact our customer service team.

2.3 The guarantee does not cover, accidental damage, modifications to, failure(s) not due to manufacturing defect(s), failure to comply with the original manufacturers' conditions of intended use, any accessories supplied. The Sleep Bed Centres cannot be held responsible for any costs arising from unauthorized repairs to equipment during the guarantee period. Only the Sleep Bed Centres or the product manufacturer or their authorised service agents can carry out any guarantee work. Any unauthorized repairs or repair attempts will void the guarantee.

2.4 In relation to new goods the company will accept liability for defective goods only to the extent that the company is entitled to make a claim under the manufacturer's guarantee and obtain from the manufacturer a refund, credit, repair or replacement of the defective goods.

3. DELIVERY

3.1 Delivery of the goods must be signed for. The address will be that registered with your payment card issuer, unless you request otherwise and we agree to such a request (at our sole discretion).

3.2 We will endeavour to deliver your goods within the time period stated (with the exception of weekends & public holidays). If we are unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. However, we shall not be liable for any loss, which may be suffered by you caused by any delay of delivery unless caused by our negligence. If delivery of the goods is delayed you shall be entitled to contact us and cancel the order. Any monies paid in respect of goods, which are not delivered will be refunded.

3.3 If goods arrive in a damaged condition you must inform us within 7 days. We shall arrange collection of the goods (other than used goods) and will either replace the goods at no extra charge, or refund any monies paid by you for the goods.

3.4 Sleep Bed Centres must be notified within 7 days if any part of your order is missing. All claims will become void after this period.

3.5 We will deliver to business addresses at your request but stress that if instructed to do so, the card used in the transaction must be officially registered to that address. Also you are agreeing that anyone situated at your business address has your written authority to accept goods on your behalf. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.

3.6 Delivery Charges. All delivery charges pertaining to items delivered within mainland U.K. are clearly displayed on the website information page named Free Delivery. Offshore deliveries, if applicable, will incur a delivery surcharge please contact our sales team for an up to date quotation.

3.7 We shall not be liable to you for any failure or delay in performance of our contract. If it is due to an event beyond our reasonable control including, without limitation, manufacturing delays, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.

4. RETURNS, REFUNDS AND CANCELLATIONS

4.1 If you are not completely satisfied with your purchase you may return it under the Consumer Protection (Distance Selling) Regulations 2000. Goods are eligible for return within 7 days of delivery for an exchange or refund.

4.2 Items must be returned in an unused condition along with the receipt or other valid proof of purchase. As we cannot be held responsible for non-delivery of returned goods we recommend that you obtain proof of posting. Please note that all goods returned must be in their original packaging with all seals intact.

4.3 We regret that we cannot accept the return of goods manufactured to a bespoke or European size and these items are exempt from the 7 day cooling off period. The following sizes constitute as bespoke:

70 x 200cm
75 x 200cm
80 x 200cm
90 x 200cm
140 x 200cm
160 x 200cm

If any product has been opened and the original packaging unsealed then these products will also be exempt from the statutory 7 day cooling off period, and your right to cancel will have ended for reasons of health and hygiene. We adhere to the Consumer Protection (Distance Selling) Regulations 2000 No.2334.

4.4 Orders that are cancelled or returned to us after the statutory 7 Day cooling off period, and goods which are returned to us for reasons other than faulty workmanship outside of the 7 Day cooling off period are subject to a mandatory 10% re-stocking fee.

4.5 In the event that the goods have already been despatched at the date of receipt of your cancellation of the order you must return the goods to us and we will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given, less our original shipping fees (which are inclusive of VAT). If you do not return the goods within 21 days of your cancellation, we will make a charge in respect of the cost of recovering the goods. The full cost of returning the product will be charged. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the website. This does not affect your statutory rights. Your statutory rights are not affected.

4.6 Please ensure that all products to be returned are clearly labelled with your name, postal address and order number.

4.7 All items for return must be heavily packaged. They must be watertight and wrapped in heavy duty PVC for added protection. Inadequately packaged items will be subject to heavy spoil during transit. If on return to our premises we find that the products from you are in a soiled or damaged state, we reserve the right to refuse delivery of those products and return those products back to you, and/or to require payment in full from you for those products and you hereby authorize us to collect all sums required for us to effect payment in full using the debit/credit card details provided to us at the time of placing your order.

4.8 The goods we sell are of a technical nature and are continuously evolving and improving. Whilst we endeavour to publish as much up to date information as is practical about the goods, manufacturers and suppliers may change details such as ticking’s, fabric, materials, finishes, fillings, colours, fibres and dies without giving any prior notice. Therefore all images and descriptions are for giving an approximate idea of the goods only at that time. The Sleep Bed Centres endeavours to keep all images and descriptions accurate and up to date but cannot be held responsible for any inaccuracies which may occur.

5. MISCELLANEOUS

5.1 We shall not be liable to you for any failure or delay in performance of our contract. If it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.

5.2 These terms are subject to English law and the parties agree to submit to the exclusive jurisdiction of the English Courts.

 

1. TRIAL

1.1
The mattress is supplied to you based upon these TERMS AND CONDITIONS.

1.2
The 30 night's trial terms & conditions strictly apply to mattresses which clearly advertise and promote the 30 night's trial promotional banner in store.

1.3 Only one mattress can be trialled per household and must be trialled for the full 30
night's period.

1.4 The 30 night's trial will commence from the time and date on which the mattress is delivered or collected by you and will end at midnight on the 30th day after that date.

1.5 Please ensure that the mattress is in a satisfactory condition when you receive it. If the mattress is soiled or damaged on delivery to you, you must tell us as soon as possible and in any event within 24 hours of delivery, so that we can arrange for a collection or (if requested) an exchange of the mattress.

1.6 If you wish to exchange the mattress during the 30 night's trial for another, the replacement mattress will not be eligible for the 30 night's trial.

1.7 If you qualify for two free memory foam pillows they be despatched once the trial period is over.

2. IF YOU'RE NOT COMPLETELY HAPPY JUST BRING IT BACK

2.1 In the unlikely event that you are dissatisfied with the mattress and wish to cancel the agreement and return the mattress to us, you must contact a member of our customer service team on 0121 288 0084 within the 30 night's trial period. We will refund all payments made by you for the returned mattress at the date of purchase, less our original delivery costs of £19.95

2.2 It is your responsibility to return the mattress back to our premises.

2.3 Please ensure that the mattress to be returned is clearly labelled with your name, postal address and order number. If on return to our premises we find the mattress in a soiled or damaged state, we reserve the right to refuse the mattress and will then require immediate payment in full for the mattress and you hereby authorize us to collect all sums required for us to effect payment in full using the debit/credit card details provided to us at the time of placing your 30 night's trial order.

3. PAYMENT TERMS

3.1 Full payment of the mattress including a delivery charge is payable prior to delivery or collection of the mattress.

4. VARIATION OF TERMS

4.1 No other variation to these terms and conditions shall be binding unless we have confirmed our acceptance of that variation in writing to you.

5. RETURNS NOTICE

5.1 If you fail to contact us during the 30 night's trial period and fail to produce our goods for return on the agreed date, we will be entitled to assume that you have accepted the mattress unconditionally. You hereby agree that if we have not heard from you at the end of the 30 night's trial period, that we may treat your silence of communication as unconditional acceptance of the mattress been trialled.
